Object

The purpose of these general terms and conditions of sale is to govern the contractual relations between, on the one hand, "the seller", the company CARVE 'N CUT MANUFACTURE, registered with the Trade and Companies Register of Grenoble under number 827 938 424 and whose registered office is located at 96 Rue des Allobroges, 38180 Seyssins (France), and on the other hand, any natural or legal person, hereinafter "the customer" or "the buyer", wishing to purchase a product or service sold by the company CARVE 'N CUT MANUFACTURE on the website www.youcarve.com.

These conditions are deemed to have been read and accepted beforehand at the time of the order and without reservation by the buyer.

Therefore, no clause or condition of purchase contrary expressed by any means whatsoever by the buyer can be opposed to the seller after the purchase.

If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector where companies have their registered office in France.

In addition, the seller reserves the right to modify its general terms and conditions of sale hereinafter at any time and from time to time, and they will be immediately applicable upon their online publication.

Order

Orders will be placed by the customer using the online interface available on the website www.youcarve.com.

Prior to the validation of their order, the customer buyer must imperatively and precisely fill in the identification form allowing the creation of a customer account.

All information entered by the customer (such as their name, first name, delivery and/or billing postal address, phone number, e-mail address, etc.) will be deemed accurate, will constitute proof of their identity, and will demonstrate their consent to these general terms and conditions of sale.

Any order implies acceptance of the prices and descriptions of the products offered for sale at the time of purchase. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below.

The sale will only be definitively concluded upon confirmation via the customer's email address of the order and payment by the seller and/or the intermediary financial institution.

The seller reserves the right at any time to block any order from a buyer with whom there is a prior dispute, immediate or subsequent to the order, such as, in particular, a payment default, an incorrect address, an abusive cancellation, or any other problem until the dispute is resolved.

In the case of a delivery address involving a third party, the actual buyer will be deemed solely responsible for the information they communicate and for the consent of said person to receive the delivery.

Withdrawal

In accordance with Article L.121-20-2 3° of the Consumer Code, the right of withdrawal cannot be exercised for goods made according to the customer's specifications or clearly personalized. Consequently, the right of withdrawal enjoyed by consumers under Article L.121-20 of the Consumer Code can only be exercised for non-personalized products sold on this site.

In the event that the buyer is a professional purchasing within the framework and for the needs of their profession, the right of withdrawal provided for by the Consumer Code will not apply.

Price

Unless otherwise stated, the selling prices of the products are indicated in euros, exclusive of tax and inclusive of all taxes, excluding delivery costs (specific to each type of shipment), the latter being invoiced in addition and indicated explicitly before final acceptance of the order.

The seller reserves the right to modify the selling prices at any time and without prior notice, it being understood, however, that the prices are guaranteed firm and final at the time of order validation.

The minimum order amount, excluding delivery costs, is set at 30 euros excluding tax, i.e., 36 euros including all taxes. Any order below this amount would result from a computer malfunction and would be considered null and void, unless otherwise and explicitly stated by the seller.

Payment

Payment for items is due in full upon order and is made online only and exclusively by credit card, Paypal™ payment, or bank transfer.

At no time can the sums paid be considered as earnest money or down payments.

The buyer guarantees to the seller that they have the necessary authorizations to use the payment method when validating the order form.

In order to make payment, the customer is directed to a secure and encrypted electronic payment terminal where they enter the necessary information for the processing of their payment. No customer banking data is transmitted to the company CARVE 'N CUT MANUFACTURE. Its responsibility is therefore discharged.

The order validated by the customer will only be considered effective once the relevant banking payment centers have given their approval. In the event of refusal by these centers, the order will be automatically cancelled and the customer notified electronically (email).

Furthermore, and concerning all payment methods, the seller reserves the right to refuse to make a delivery or to fulfill an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is in the process of being administered.

Delivery and deadlines

Home deliveries of products are made to the delivery address indicated in the order form by the buyer, who is responsible for the accuracy of the information entered and recorded. All costs related to an incorrect or incomplete delivery address will be borne by the customer, and any package returned for this reason and not claimed by the buyer within 90 days will remain at the seller's disposal.

It is the buyer's responsibility to check the condition of the goods upon delivery. In case of damage found on the packaging, the customer must imperatively unpack and check the condition of the items, and if necessary, they must imperatively refuse the package and note the appropriate reservations on the carrier's delivery note. This reasoned protest must imperatively be confirmed by registered mail to the carrier within three days of delivery, and a copy of this postal letter must be sent to the seller.

A request for the return of goods can only be taken into account if it has been previously accepted by the seller within 7 days following the date of receipt of the goods. The return of goods can only be accepted for products in their original condition. No returns with postage due will be accepted.

In the event of an anomaly or non-conformity of the items after unpacking, the customer must obligatorily send their claims to the seller electronically (email or online contact form), on the day of delivery or at the latest on the first working day following delivery. After this deadline, any claim made may be rejected by the seller without the possibility of recourse by the customer.

Deadlines of any kind (administrative, manufacturing, delivery, etc.) are given for information only and without any guarantee of compliance. Any failure to meet a deadline in the processing and execution of an order cannot be used as a basis for the cancellation of the order, refusal of the goods, or negotiation to claim a price reduction or to obtain damages.

Warranty

The seller undertakes to remedy any manufacturing defect resulting from a defect in materials or workmanship (including assembly if this operation is entrusted to them) within the limits of the provisions below. The seller's obligation does not apply in the event of a defect arising either from materials supplied by the customer or from a design imposed by the latter. The following are totally excluded from the warranty: consumables (double-sided adhesive foam, hardware…)

Any warranty is also excluded for incidents due to fortuitous events or force majeure as well as for replacements or repairs resulting from normal wear and tear of the equipment, damage or accidents resulting from negligence, lack of supervision or maintenance, or abnormal or non-compliant use with the supplier's instructions for this equipment or inadequate storage conditions.

The seller does not cover damage and wear resulting from a special, abnormal, or improper adaptation or assembly of the products. The warranty is limited to the replacement or repair of defective parts without the customer being able to claim damages, for any reason whatsoever.

If the seller is not in charge of the installation, any defect related to it is excluded from the scope of its warranty.

Under the warranty, the seller will replace free of charge parts recognized as defective by its technical services. This warranty does not cover labor costs and those resulting from the following operations: disassembly, reassembly, transport to the site.

Notwithstanding this commercial warranty, the seller remains bound by the legal warranties in force.

Liability

On the pages of customizable products, the illustrations presented in the product preview area are simulations intended to help the customer in their choices of product customization with a visual preview approaching (shape, texture, and color) of the ordered product. Furthermore, these graphic simulations are given for information only and are not contractual. Thus, for reasons of technical manufacturing constraints, and the intrinsic irregularity of texture and color of certain materials, the actual product may differ significantly from the graphic preview presented (difference in the actually machined outline, differences in color and texture).

The seller cannot be held responsible for the following elements: spelling, grammatical, or punctuation errors made by the customer, graphic and technical characteristics of files transmitted by the customer, errors by the customer in their choice of product options.

The photographs, texts, graphics, information, and characteristics reproduced and illustrating the products presented are not contractual. Consequently, the seller's liability cannot be engaged in the event of an error or omission in one of these photographs, texts, or graphic information. Furthermore, despite all the care that the seller takes in checking the technical specifications and product descriptions, errors or omissions are possible, and in this case, the seller declines all responsibility for the validity of these contents.

Hypertext links may refer to other sites outside the youcarve.com domain. The seller disclaims all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.

The seller's liability cannot be engaged for damage resulting from the customer's use of the Internet, such as data loss, intrusion, viruses, service interruption, or other problems independent of the seller.

The seller will not be held civilly or criminally liable for damages or consequences related to inappropriate or unauthorized use of the site or its content by the customer.

The seller can in no case be held responsible for direct or indirect, material or immaterial damages, including loss of profits or loss of operation, that may occur following the purchase of products on the website www.youcarve.com.

The seller cannot be held responsible in the event of force majeure preventing the execution of the contract concluded under the normal conditions of its obligations. Force majeure is considered to be all circumstances beyond its control: strikes, fire, natural disasters, interruption of telecommunication networks or difficulties specific to telecommunication networks external to those of the customer, and other cases of force majeure usually retained by the jurisprudence of French courts and tribunals and occurring at the seller as well as at its own suppliers. Furthermore, in case of force majeure, the seller undertakes to notify the buyer as soon as possible.

The computerized records of the company CARVE 'N CUT MANUFACTURE will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.

Law and jurisdiction

The language of this contract is French. These general terms and conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction. More specifically, only the Commercial Court of GRENOBLE will have jurisdiction in the event of a claim or dispute relating to the interpretation or execution of these general terms and conditions of sale governing the contractual relations between the buyer and the seller.
